1) A seguradora não pode se eximir do dever de indenizar, alegando omissão de

doenças preexistentes por parte do segurado, se dele não exigiu exames clínicos prévios, salvo quando restar comprovado que ele agiu de má-fé.

2) O simples atraso no pagamento de prestação do prêmio do seguro não importa em desfazimento automático do contrato, sendo necessária, ao menos, a prévia constituição em mora do contratante pela seguradora, mediante interpelação.
